1. Acceptance
By installing the BottleneckIQ Forge app on your Atlassian Cloud Jira instance, you ("the customer") agree to these Terms of Service. Atlassian's own Marketplace Terms of Use also apply.
2. The service
BottleneckIQ is a Forge app that reads Jira issue data, computes flow metrics, and surfaces them as a dashboard inside Jira. The full functional description is in the Marketplace listing.
3. Acceptable use
- You may install BottleneckIQ on any Atlassian Cloud Jira instance you administer.
- You may not reverse-engineer, decompile, or attempt to extract the app's source code.
- You may not use the app to violate Atlassian's terms of service, applicable law, or any third party's rights.
4. Subscription and payment
Subscription is billed through Atlassian Marketplace per the pricing tier you select (see the Marketplace listing for current pricing). Atlassian handles all billing, refunds, and tax. The vendor is not party to the customer's billing relationship with Atlassian.
A 14-day free trial is offered on each new install. After the trial period, continued use requires an active paid subscription.
5. Termination
- By the customer: uninstall the app from your Atlassian site at any time. On uninstall, your data is deleted per the Privacy Policy.
- By the vendor: we may suspend or terminate access for non-payment, violation of these Terms, or material misuse of the service. We will provide reasonable notice except in cases where notice would compromise security or legal obligations.
6. Service availability
The service runs on AWS infrastructure in US East 1. We aim for high availability but do not guarantee 100% uptime in this version of the Terms. Status and incident communications go to the support email; no separate status page is published yet (planned for a future phase).
7. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE VENDOR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. WHERE APPLICABLE LAW DOES NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THIS DISCLAIMER APPLIES TO THE EXTENT PERMITTED BY LAW.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE VENDOR'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT THE CUSTOMER PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE VENDOR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
9. Data ownership
The customer retains all rights, title, and interest in their data. The vendor's processing of the data is governed by the Privacy Policy.
10. Modifications
The vendor may update these Terms from time to time. Material changes will be communicated via the Marketplace listing and / or in-app notice at least 30 days before taking effect for paid customers.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which the Vendor is established, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms will be resolved in the competent courts of that jurisdiction.
